Athletic Trust Tax Class Action – Cassels Brock

On April 15, 2009, a class action lawsuit was launched on behalf of the proposed representative plaintiff Jeffrey Lispon, against Cassels Brock & Blackwell LLP (“Cassels Brock”) in respect of allegations relating to a legal opinion prepared in support of a timeshare program operated and promoted by the Athletic Trust of Canada (the “Legal Opinions”) for anticipated tax credits. Mr. Lipson brings the action on behalf of individuals who participated in the Timeshare Program in 2000, 2001, 2002 and/or 2003 and received Timeshare Weeks from the Athletic Trust and donated them, together with a cash donation, to one or more registered charities (the “Class Members”).

Unpaid Overtime – Scotiabank

On December 10, 2007, lawyers from Roy O’Connor LLP and our co-counsel Sack Goldblatt Mitchell LLP (and now with additional co-counsel Sotos LLP) launched a class action lawsuit on behalf of the representative plaintiff Cindy Fulawka, against The Bank of Nova Scotia (Scotiabank) in respect of unpaid overtime. Ms. Fulawka brings the action on behalf of current and former front-line sales staff (limited to Personal Banking Officers, Senior Personal Banking Officers, Financial Advisors or Account Managers Small Business – or their predecessor positions) who worked at any of Scotiabank’s retail branches across Canada.

In June of 2007, lawyers from Roy O’Connor LLP and our co-counsel Sack Goldblatt Mitchell LLP (“SGM”) (and now with additional co-counsel Sotos LLP) launched, on behalf of the proposed representative plaintiff Dara Fresco, a proposed class action lawsuit against CIBC in respect of unpaid overtime. Elliot Lake – Algo Centre Mall Collapse Class Action

On July 6, 2012, Roy O’Connor LLP launched a class action lawsuit on behalf of the proposed Representative Plaintiffs seeking the certification of their action as a class proceeding as well as monetary damages. The current defendants to the action are the owners of the Algo Centre Mall (Eastwood Mall Inc. and Bob Nazarian) the City of Elliot Lake, the Province of Ontario, and the engineering firm that performed an inspection on the mall.
