In reasons for decision released on October 4, 2022 a unanimous Divisional Court overturned the dismissal of the Plaintiff’s certification motion in Mackinnon v Volkswagen Group Canada  et al and directed a further hearing to determine if the balance of the test for certification has been satisfied.
